Terms for Phyber Prepaid Card (Issued by Pine Labs)

This document sets out the Terms and Conditions ("T&C") applicable to the RuPay Card issued by Pine Labs.

Pine Labs Limited ("Pine Labs") has been granted an authorization to issue prepaid payment instruments by the Reserve Bank of India ("RBI").

Pine Labs will issue RuPay PPI. This Card is a prepaid RuPay card which can be loaded for expenses as per the User's company policies. Users can shop online using the Card wherever RuPay payments are accepted, strictly in accordance with the User's company policy. The User hereby consents to Pine Labs sharing transactional and personal information with its third party service providers only for customer support and additional services.

These T&Cs may be updated from time to time at the sole discretion of Pine Labs. The Cards are reloadable Full KYC PPIs which are issued and operate in accordance with the RBI Master Directions, as amended from time to time.

The following terms and conditions are applicable to the User/Cardholder upon being provided the Corporate Expense Card:

All Cards shall be valid for a period of 5 (Five) years and shall remain valid till the date mentioned on the face of the Card. The validity of the Card may be extended, or a replacement card may be issued on expiry, upon request from the Corporate (User's company) at the sole discretion of Pine Labs. The associated prepaid payment instrument account is valid for 10 (Ten) years.

The Cards can be redeemed at any of the online stores which accept RuPay instruments. However, there are certain Merchant categories, as listed at www.pineperks.in/termsConditions, wherein the Card cannot be redeemed.

The Card cannot be resold, transferred for value, or redeemed/exchanged for its value in cash by the Cardholder.

One Card will be issued per Cardholder, identified by a unique mobile number.

This Card will only be issued by Pine Labs on request of the Company and distributed by our service provider or us to the Cardholder on the Cardholder agreeing to these Terms and Conditions (as updated from time to time) and also successfully fulfilling Know Your Customer ("KYC") criteria as defined by the Reserve Bank of India.

• The amount loaded per PPI cannot exceed Rs. 2,00,000/- (Rupees Two Lakh). The amount outstanding per Card at any point of time shall not exceed Rs. 2,00,000/- (Rupees Two Lakh). Subject to applicable RBI Master Directions, Pine Labs may set periodic transaction limits on the Card at its sole discretion.
• UPI: You can link your Full KYC PPI on the PlusPay app for doing UPI transactions. UPI limits as prescribed by NPCI will apply on all UPI transactions.

The amount loaded per PPI during any month shall not exceed Rs. 10,000, and the total amount loaded during the financial year shall not exceed Rs. 1,20,000. The amount outstanding per Card at any point of time shall not exceed Rs. 10,000.

The Cardholder hereby acknowledges and agrees that if there is no Transaction for a consecutive period of one (1) year on the Card, subject to validity of the Card, the Card shall be made inactive by Pine Labs by sending a notice to the Cardholder.

The Card can be closed at any time, and the balance funds available in the Card can be transferred 'back to source' (payment source from where the PPI was loaded) at the time of closure. The Cardholder's company should write to support@phyber.care to understand the refund process.

Any change of Cardholder credentials, like mobile number, e-mail, etc., will have to be communicated by the Corporate only. The Cardholder cannot request any changes directly.

If the Cardholder information provided by the Corporate or the Cardholder is found to be incorrect at any time, the Card in question is liable to be cancelled and the entire amount forfeited, and no claims in respect thereof will be entertained by Pine Labs.

The Card will always hold zero balance and will be instantly funded at the time that the Card is used for redemption or payments. The limit for contactless transactions will be as prescribed by RBI.

The Cardholder shall indemnify, defend, and hold harmless Pine Labs and its service providers from and against any and all third party liability, losses, costs, and expenses (including reasonable attorneys' fees) relating to or arising out of the breach of these terms and conditions, the negligence or wilful misconduct or fraud by the Cardholder or Corporate or its employees or agents, breach or non-compliance of the rules/terms and conditions relating to the Card, and/or fraud or dishonesty relating to any transaction by the Cardholder. The User shall also indemnify us and our service providers fully against any loss on account of misplacement of the Card.

The Card is issued upon request by the Corporate; the amount on the Card may be completely controlled by the Corporate (Cardholder's employer). The Employer may load money, withdraw money, set limits, and even block the Card without any prior notification. Pine Labs is not liable for any misuse/negligence of the Card, or of the money loaded in the Corporate's company account linked to the Card, by the Cardholder.

Partner and Pine Labs do not make any warranties, express or implied, with respect to the Card, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose or that the Card will be free from errors or defects, and is provided on an 'as is' basis. In the event the Card is non-functional, the Cardholder's sole remedy will be the cancellation of the Card.

The Cardholder shall inform Phyber by contacting Customer Care at 9611077318 or by email at support@phyber.care within 10 (Ten) days of occurrence of any transaction if any irregularities or discrepancies exist in such transaction, or if the Cardholder has any query or complaint in relation to the Transaction, including for any unauthorised transaction. If Pine Labs does not receive any information to the contrary within 10 (Ten) days of occurrence of any Transaction, it shall be entitled to assume and proceed on the basis that the relevant Transaction(s) was effected without any irregularity/discrepancy.

Subject to the foregoing, all transactions as aforesaid shall be dealt with in accordance with the Customer Grievance Redressal Policy of Pine Labs, which can be accessed at https://www.pineperks.in/grievancePolicy. The Cardholder can reach out to Pine Labs via email at prepaidsupport@pinelabs.com or by contacting 080-64534440 for any complaints and escalation as per its grievance redressal policy. These cards will be distributed by authorised Phyber personnel only.

All fees, surcharges, goods and applicable taxes with respect to the Card shall be borne by the Corporate or the Cardholder. Pine Labs shall have no liability towards the same. There may be a surcharge applicable on certain card transactions. In such an event, the same will be deducted from the card balance available on the Card at the time of the transaction. In case the card balance is not sufficient to provide for the surcharge, the transaction shall be declined.

For any dispute in relation to the Cards, the decision of Pine Labs shall be final in this regard. Any disputes and claims in relation to the Card shall be subject to the laws of India and the exclusive jurisdiction of the courts at New Delhi.
